OTD Christmas Gift away: 2nd Place Winner: Analisa “Ana” Santillan


OTD kicked Christmas off with the Giftaway Program which granted employees the opportunity to share the love and joy of the  holiday season to fellow employees and Kythe Foundation recipients.  A total of 40,00) Pesos was distributed to the entire OTD, bestowing upon each employee, the chance to give out 200 pesos to worthy recipients.

OTD Team members eagerly casted their votes, as to whom they would wish to present their cash donations to. In a span of a day, the much awaited results were announced...

The OTD team greatly anticipated Ana’s awarding ceremony. Wide smiles grazed everyones faces and enthusiastic claps filled the office as she was present her Php 2100 pesos for placing 2nd on OTD’s December Giftaway program. Garnering numerous votes and compliments from her team mates, Ana has indeed proven to be one of OTD’s top employees. She has certainly lived up to her title as the first R6 recipient, and she has proven to be a great example to others.
Her infectious positivity and enthusiasm have not gone unnoticed, and it is because of these she is heralded as the 2nd Giftaway winner!

Cheers erupted as our very own, “Mommy Che”, Michelle Celi, was awarded Php. 1400 pesos for placing 3rd on OTD’s December Giftaway Program. No one was surprised that Che was one of the top three recipients, as she has served as an inspiration to the whole team, and most of the night shift people would attest to this. Her constant guidance and her thoughtfulness have earned her these gracious comments from her anonymous donors:

Our newest member, Suman “Sammy” Mukherjee, a web developer from Vietnam was the first to experience OTD’s warm welcome surprise. Check out his reaction as he enters the office for the first time, and is greeted by an enthusiastic OTD crowd. The whole team takes the time to meet and greet our newcomer and he is greatly amused by this warm welcome.  Later in the afternoon our second new recruit, John Grande, was met by our afternoon shifters, all of whom were eager to greet the new developer.

On September 14, 2011 the OTD team celebrated Virtual Assistant Angelo "Gali" Gonzaga's last day at OTD by giving him an enthusiastic clap out. It was a sad day for the team as they said their goodbyes to Gali who has proven to be a greatly valued team member. Though it was his last day, Gali continued to brighten and bring life to the team by encouraging everyone to remain in high spirits as he did some funky dancing and delivered his final message to the team and to the company.

 In his final message he states, "I'll always treasure my experience working here".

In Photo: Jayson was awarded one of his many employee Referral Bonuses. During his stay with OTD, he has been given excellent commendations from his paired clients and won accolades from his peers.


Jayson Ronald Obos was a promising employee who has stayed with us for more than a year. An world-class employee, he has been paired with premier accounts and has done exceptional work. However, he began to log an excessive number of absences that could have warranted a termination notice. Moreover, he has not informed Human Resources that he has not been doing work for the past two weeks simply because his latest client was busy to attend to other functions, and elected to spend most of his time on Facebook while waiting for a project from his client to work on.

Jayson’s actions deeply upset his paired client, which resulted the latter to pull their account out from OTD and demanded a refund.

Jayson admitted his addiction to the social networking site and asked us to block access to it. Jayson proactively suggested to either deduct two week’s worth from his succeeding pay or endorse the monies to management to be given to charity to compensate for the refund and lost account. He even picked the name of the child he wants to support from the charity suggested.

Jayson then requested to be put into a premier account, and we obliged, knowing his capabilities to perform well and to be of value to the new account. However, immediately, Jayson decided to turn the opportunity down because he doesn’t want to do calls. It was odd, considering that it was a non-voice account and that he knows calls made on non-voice accounts are only in the rarest of occasions. Because of Jayson’s indecisiveness and OTD’s uncertainty of where to place him, the employer had him on a two-week paid leave to think about what and how he could be of value to the company.

Two weeks later, Jayson didn’t show up. We tried to contact Jayson, but later on advised Human Resources that he simply wants out via SMS. Human Resources requested him to come in and properly tender his resignation.

Jayson wanted OTD to return two week’s worth of deducted wages and allow him to properly resign.

This is one of the many stories that every employer can relate to. There may be various reasons as to why an employee leaves, but it is standard practice and in legal writing for employees to tender resignation and render 30 days of work, of which Jayson hinted of doing so. And in our business, leaving the company in the proper procedure is essential: Jayson was contracted with a client and is aware that he assumes the responsibilities to co-manage the business operations.

It takes about 3, albeit arduous months to prepare employees and pair them with clients who are in meaningful businesses. Their roles are significant to the business operations that they may take in as many roles as the business demands. The cost of training, setting them up with  cutting-edge productivity tools and time to prep employees for operations required by paired clients easily offsets and more the price we offer to clients to pair with virtual employees. And the cost of finding a replacement to perform work for the client for remaining 30 days tips the scale that there is no real, immediate profit to it even with a training bond imposed.

However, this story goes beyond the costs of employees leaving the company and profits lost in the process. This goes straight to the heart of the working ethic of the Filipino worker.


The Employment Bond Question

And so, with our heart broken for the nth time, we had an employment bond in placed for the first time.

There was, and has been a lot of flak about the employment bond. In the Philippines, it is a hot-button topic both by employers and employees. Nonetheless, the employment bond is a standard in all operating businesses to insure and protect employer’s investment to the newly-gained employee. It is to supposedly secure an employee’s commitment to return the investment within a contracted term of which the employer deemed will expect fruition of the invested amount from the employee.

As a company built on trust, we have encouraged a culture of communication between members of the team and management. When a face-to-face interaction isn’t possible, we have taken advantage of technologies and extended the practice online: chat, video conference, e-mails and screen-time sharing. Everyone is encouraged to speak out and share their minds and expect immediate feedback via blogs, daily and end of day reports. We even award team members for their brilliant ideas and implement their brilliant ideas right away.

Yet, the final blow was Jayson Obos.

Our first draft drew many reactions and a tense environment among the team for the first time ever. And they were not alone. The recent culture in the Filipino workplace dictates employment bonds are a suppressant to the civil liberties. And because of these notions of autonomy and the supposedly crippling of employment freedom, this has socially impacted morale and eventually productivity.

There is also the argument about the money imposed on the bond. The matching of the price of investment towards the number of years is viewed as overpriced by many. Discussion forums pop up from left to right about the unjust ratio of the bond price to the number of years contracted in service and the training that employees get from their employers.

The frightening realization of these supposed calls of unjust treatment begets a bigger social problem that, although trying not to generalize, but many Filipino workers are too blind to accept.

From call centers to small offices, extending to the government and to the lone, minimal-wage worker, it seems that Filipino are attuned to always take opportunities and get away with accountability. What’s more alarming is that we have a lot of concrete examples to support that. As such, there breeds mistrust. In the workplace, the existence of bonds was never demanded until there was a trend of workers dropping off like flies for a bunch of reasons. And Filipinos, with such a very colorful culture, are very creative with them.


How We Party
In this photo: The OTD team in party mode. Like the many businesses and individuals who have invested in the Filipino, we believe that Filipino workers are world-class employees. The creation and placement of employment bonds or similar agreements are not a money-making scheme, but are to ensure the caliber of work performance and commitment of Filipinos in the workplace.


The real need to bring up such bond is to level the trust once initially achieved with the initial signing of the contract. As we are in the business of selling time, contracting people to come in for work requires absolute attendance and strict compliance to the company’s policies.

Although we are sad to see Jayson leave abruptly, we smile at the thought of many long-term, world-class employees we have in the team, and who have never been subjected to employment bonds. We are inspired to continue with the goal of providing multiple, fulfilling and high-paying careers to deserving members of our team and to future, equally-deserving individuals.

But, like many other employers, we beg answer to the question: is the employment bond instrumental and healthy for the team? Does it remedy attrition and incidents like withe Jayson? Probably, but it remains to be seen as one, big, fat band-aid to a festering wound.

A Series of Mistrusts

These contracts such as bonds or service agreements are treated as one-sided contracts, often viewed on the part of the employer. However, in a workplace culture that breeds mistrust, why not? For example, it is of obvious fact that workers easily shift from one company to another not always because of a meaningful career, but because of a higher compensation, benefits, or for more social reasons.

This scenario should not just come to the attention of employer and employees alike. The Department of Labor and Employment (DOLE) which purportedly acts as the mediator and defender of laborers should also come into mind.

According to the Labor Code:
Art. 4. Construction in favor of labor. All doubts in the implementation and interpretation of the provisions of this Code, including its implementing rules and regulations, shall be resolved in favor of labor.

This is highly understandable, but are we safe to assume that the laborers then are always the “victims” in this dog-eat-dog word? If the DOLE members are dead-set on defending supposedly abused employees such as Jayson, without even giving the tiniest thought as to whether such claims are actually valid, then employers beware.

Keep in mind that in a relationship between an employer and an employee, BOTH parties are accountable for whatever actions they engage in, whether not it is meant to strengthen or threaten that legal bond.

If employers are expected to provide the utmost care for their employees, treat them with respect and give them their dues, then the same should be expected from the employees. Employees who expect to be rightfully treated must earn that right by reciprocating this written and unwritten rule.  

The employee has as much power as the employer to cause and inflict the other, damages, not to mention waste the others TIME, MONEY and EFFORT.

In Northern America, grievances that are proven to be trivial and unsupported are deemed as “Nuisance Cases”. Exactly as what it is called, cases like these are a nuisance. Not only would you waste your employer’s precious time, money and energy, but you’d be doing the same for the government agency. You won’t just be wasting valuable resources, you’d pretty much bite the hand that fed and took care of you.

And if the employer is absolved of allegations made against them, would the employee be able to account for tarnishing the employers name name and ruining the trust that they have given the employee? We doubt it.

Laborers should first and foremost, seek to resolve their issues with the employers first before seeking legal aid. And for these, we have not failed in that department.

We treat our team equal, and for that, we earn respect as we respect the team. Here’s what goes on in a team conversation:


1.  We identify what you really want. We do not beat around the bush.
2. Schedule a perfect time to talk. In the business of selling time, we respect each other’s time as we value ours.
3. Think like a business man. Our team are our shareholders. We align our ideas to the interest of the whole.
4. Get your documents ready. Our cutting-edge productivity and content management systems in place allow us to present documentation at the ready.
5. Stay calm. We level the playing field here.
6. Get ready to be declined. We encourage pushback, debate and pragmatic thinking.
7. Let this be a meaningful experience to you. We believe in every outcome, favorable or not, lies an opportunity we could improve or change for the better (The Kaizen principle).

A series of recorded chats and face-to-face time was invested to cater to Jayson’s uncertainty, almost to a point that it was more costly and time-consuming as to automatically fire him, of which we should have clearly done in the first place. And yet, it wasn’t our philosophy to just fire people.

DOLE on the other hand, should also consider the employers losses and should take into consideration how such claims also affect them. Needless to say, though DOLE may only be doing its job to ensure that their defendant is getting what is due him, it is pertinent that they ensure a complainant’s accountability for what ever damages made to the employer, especially if the complainant was proven to have brought up an invalid or moot case.

If employers are expected to answer to any claims brought up against them, including the reparations they are required make, it is only fair that the employees who has brought the issue to court must not be absolved from any reparations. If the employees are revealed to be the victims in such cases, then the employee must pay for the tangible and intangible damages their allegations have brought upon the employer.

Such instances are deplorable because some employees are liable to take advantage of the protection given to them, and some tend to be abusive of their granted rights.


The Flipside

OTD has been very gracious to its employees, even if some spit them in the eye. And just like in a marriage, we build open and honest relationships with communication. OTD wants to set an example: that we stay and continuously provide careers to honest, hardworking and intelligent Filipino workers out there who are looking to earn a decent living, Having people like them is a privilege that we want to nurture and prolong the relationship with, and a social responsibility, even if it in the end they seek their success outside of the company eventually.

We hope that there wouldn’t be any Jaysons who’d steal their hard-earned spots.
